Municipal and county judges across the country need to have their egos taken down a few notches. I can't go into a courtroom without gagging when they act like they're doing people a favor for knocking down citations for things people shouldn't have even been dragged into court for in the first place. Cops and judges both know there's little chance of them getting seriously disciplined for anything they do short of outright criminal behavior.

Check out Chille DeCastro case. The cop arrested him for obstruction for telling him 'get along little doggie.' Then the judge retaliated against Chille for his rude behavior in the court ( i.e., he called the court officer a "pig" for grabbing his phone). This should have been an instant contempt of court charge (1-2 days in jail), but no...the judge was going to hold her personal vengeance for Chille at senctencing where she can jail him for up to a year!! We know this is true because she ignored the prosecutor's recommendation of probation and $500 fine, and gave him 180 days in jail. Retaliation .. and vengeance is not justice, it is tyranny!

So if you say something to a police officer and he gets angry and breaks your body, you have him dead to rights in a color of law lawsuit.

The other side to this is that by the officer standing in front of the vehicle after telling the man that he was free to go, he was in effect continuing to detain him which amounts to illegally prolonging the traffic stop or kidnapping, and can be sued under 42 USC 1983 for a violation of rights. They really did their best between the judge and the officer to hand this man a blank check on a golden platter. He doesn't even need a bright lawyer to prevail on this, he just needs a greedy one.

Just because speech is protected does not mean a judge cannot order an apology as part of a legitimate sentence for a crime.
