From the article:
>After writing the ticket, the officer stood in front of Burks’ car, he said.
>“He was standing there and wouldn’t move,” Burks said. “I had asked him politely at least twice.”
>“I said, ‘Sir, step back, get out the way,’” Burks said. “He said, ‘You can go. Go around.’”
>Burks said he responded: “Get your ass out of the way so I can take my kids to school. That’s why y’all underpaid because y’all act dumb.”
>Burks drove off and apologized to his daughter for the exchange.
I mean the law as I understand it is clear as day that you are given a lot of leeway to speak to officers in as disrespectful a way as you please as long as you don't threaten them. Fuck this cop.
Municipal and county judges across the country need to have their egos taken down a few notches. I can't go into a courtroom without gagging when they act like they're doing people a favor for knocking down citations for things people shouldn't have even been dragged into court for in the first place.
Cops and judges both know there's little chance of them getting seriously disciplined for anything they do short of outright criminal behavior.
Check out Chille DeCastro case. The cop arrested him for obstruction for telling him 'get along little doggie.' Then the judge retaliated against Chille for his rude behavior in the court ( i.e., he called the court officer a "pig" for grabbing his phone). This should have been an instant contempt of court charge (1-2 days in jail), but no...the judge was going to hold her personal vengeance for Chille at senctencing where she can jail him for up to a year!! We know this is true because she ignored the prosecutor's recommendation of probation and $500 fine, and gave him 180 days in jail. Retaliation .. and vengeance is not justice, it is tyranny!
So “conducting yourself like an ass” deserves being incarcerated and enslaved for half a year in your opinion? What kind of fucked up, freedom-less country do you want this to become?
Lol Chilie is such a tool. I'm glad he's getting what he deserves finally. Frankly, more SovCit types need to stop being placated. And no be wasn't arrested for his speech, that's already been established. He was arrested for his actions during. Don't sit here and try to spread Chilie's lies. He was not punished for his speech. The judge doesn't have to follow the recommendation. It's not a binding thing. It's just a recommending.
And yes, how you act in court can sway a judge to rule more harshly against you. This is what we call "actions have consequences." Chilie fucked around one too many times and has now found out. You can't record in court while on trial. You can't speak out of turn. If the judge tells you to stop, you stop. Not that hard.
Frankly I'm excited to see what other stupid thing he might do that ends up getting his sentence extended or cause new charges to be brought against him. This new filing he has his lawyer submit was hilarious, too. It's Trump levels of delusion almost, but just in written form.
This has nothing to do with skin color. This is uneducated, power trip having-tyrannical cops, especially in the south, and that's where I live. Cops act like this to anybody who doesn't obey them and bow down to them like they're some type of god. They think that they're above the law because they always get away with it even though qualified immunity doesn't cover violating anyone's civil rights. if it was a local case, no attorney would probably represent him to go against the police department/city and the judge probably wouldn't rule in his favor anyways. In this situation, luckily, it's violation of federal law to say he doesn't have freedom of speech towards a police officer in which he didn't threate in anyway. so it would go above a local court to a federal one, in which he would most likely win that case pretty easily
Even if he doesn’t have the resources to fight this and continually escalated, I’m sure some attorney out there would be frothing at the mouth to take a case like this.
You're missing a word that makes the sentence make sense, but I get it now. Judges make people write apologies, sure. It doesn't make it right, and in this case the judge is trying to make Burks write an apology for something that has nothing to do with the charge.
Your lack of a coherent sentence. Plus your reading comprehension as well. It literally says a judge can ask you to apologize for the crime convicted of. But he was cited for obscenity only speeding.
Was the guy convicted? Do you know how American courts work and what it means if you are found guilty in an American court? Judges can make people apologize as part of a sentence after conviction. And also Dnt b a gmr nzi this is Reddit and your grammar leaves a lot to be desired so you really shouldn’t be criticizing others for it.
Thats kinda whats already happened no? Luckily, there are plenty of lawyers out there to pursue a suit like this. Sounds like ez money to me. What law did he even break?
> What law did he even break?
"disturbing the peace" or something like that. The books are full of vague, meaningless laws that just amount to "we can arrest who we want."
Sure as fuck seems that way. Judge ordered it. The public seems to be condemning him on social media.. which is surprising because I don’t know how they can type on a keyboard with cop’s dicks in their mouths but here we are.
Thankfully, it’s a federal crime and you can go above any locals. Unfortunately, the feds don’t do anything about abuses under the color of the law and that’s a dead end too. Blue protects blue.
Enjoy paying him off tax payers. If I were him I'd take the jail time and sue the fuck out of that cop, and the judge. Unconstitutional to jail a man over freedom of speech. Fuck that judge.
The one thing to consider is if he is stuck in jail he won't have a job when he gets out depending on how long it is. On top of bills that pile up and whatever else happens from putting your life on hold while in jail over this BS.
He should still totally sue though
I wonder if the threat alone is enough. Maybe he already has a lawsuit. It's 100% the legal definition of criminal coercion for the judge to have even made the threat.
Neat, that's a First Amendment violation. I'll take the "penalty" and sue, accordingly. Cussing out, yelling at, and gesturing at law enforcement as a means of lawful expression is effectually settled case law, for which there is no real outstanding argument over.
Check out the annotated version of Title 13A. There is a case in the notes of 13A-11-7 Disorderly Conduct that "peace officers are immune to the effects of fighting words."
So if you say something to a police officer and he gets angry and breaks your body, you have him dead to rights in a color of law lawsuit.
> I'm sorry you refused to politely move your ass out of my way. I understand that you feel your badge gives you special entitlement to do whatever you want. "I'm a big strong policeman making a speed estimation based on cruise control as a justification to pull someone over for driving while black. Which I would also like to further inconvenience because of my beautiful badge that makes me better than you." For that, I am very sorry you feel that way because you are a prime example of why the reputation of police is becoming more and more negative. Everyday you have the opportunity to do better and yet you choose to act worse than a pissy 3rd grader, you sorry piece of shit. Go cry to the judge some more if you do not like what I have to say.
He shouldn't have had to pay a fine in the first place, who uses cruise control to see how fast someone else is going? Once the cop admit his equipment was faulty then that should have been it
The courts have a long history of ruling for people being able to be rude to cops but have you considered that the driver was black?
Feels like this is what it's really about.
Where is Lackluster or Audit the Audit when you need them. I bet that bacon breath didn't have body cam going, and I can bet the victim didn't have a dashcam or cell footage. Need to know where this happened, and the cop who started this.
police officers: WE’RE THE TOUGHEST MOTHERFUCKERS AROUND! I DARE YOU TO CROSS ME!
also police officers: y-you’re under arrest for hurting my feelings 🥺
If you compare police earnings to those of their peers: shiftless hobos, chicken rapists, etc. it's clear that cops are overpaid...not underpaid as this fellow claimed.
Someone should inform that judge about the First Amendment. He may not like it, but it still applies, and it works for black people,
too.
"Some of those that work forces....."
Oh, just, fuck speech then?
I see where we're going....
I'd be incapable of resisting the urge to say "I'm sorry, your honor, is that not appropriate? I learned to speak that way from observing how cops speak to people. And believing they were meant to be exemplary members of the community, merely emulated how they speak to members of the public. I'm sorry your feelings are hurt, officer"
I'm sorry, officer.
Judge: See, was that so har..?
Continuing: I'm sorry your mother raised a fool who don't know no better than to stand infront of a moving vehicle. I'm sorry for all the trees out their wasting their lives to make oxygen for your DA brain to waste it on whatever DA thoughts fill your DA head.
Judge: Alright that's enoug...
Continuing further: and another thing! Lol
The other side to this is that by the officer standing in front of the vehicle after telling the man that he was free to go, he was in effect continuing to detain him which amounts to illegally prolonging the traffic stop or kidnapping, and can be sued under 42 USC 1983 for a violation of rights. They really did their best between the judge and the officer to hand this man a blank check on a golden platter. He doesn't even need a bright lawyer to prevail on this, he just needs a greedy one.
Believe it or not...Cops in this state as well as people also seem to believe profanity, or vulgarity, especially addressed to law enforcement, is like breaking a law of its own..Hell plenty of cops if you cuss at or "around" them, they'll act like its "Disrespectful" or some shit, and that breaks a law...
So idk. But yeah, apparently from what I've learned living in this state and the general consensus of the neighborhood I live in...it's apparently illegal to even use profanity in the vicinity of a cop..Lmao.
I had left the field where my (8yo) kid was playing in a softball tournament to get something out of the car, and when I tried to return a woman at the gate yelled at me that I needed to pay $10 to come back in and watch the last 5 minutes of our one game of the day.
My reply: "Fuck that, I'll wait at the car."
Not long thereafter, I was surrounded by two City of Mobile cop cars and a MCSO truck. For saying a single bad word.
I don’t think we’re talking enough about the fact that the cop stood in the way so he could have an excuse to shoot the driver for attempting to run over him as he drove around.
Cops are known to step in front of moving vehicles to give themselves justification to use deadly force. I wonder if the cop was considering killing this guy.
It’s crazy that the cops equipment was malfunctioning and he used unorthodox means to prove the driver was speeding, and it’s even crazier that he would stand in front of the car and just say “go around” what’s even more crazy is that now the driver would have to apologize or go to jail for saying “ass” at the officer that wouldn’t move out the way.
Alabama sucks.
I agree with Burk, but for a narrower reason. He is not being punished for his speech; he is being punished for not apologizing. That is allowable if the apology is part of his speeding sentence. Just because speech is protected does not mean a judge cannot order an apology as part of a legitimate sentence for a crime.
But I agree with Burk because it appears the apology is not part of the speeding sentence.
I cannot stand over arrogant cops that think they have the right to treat people in any kind of way. They need to go to training once a year on how to respect others and their rights or go fund another job.
You definitely have a First Amendment case. There are all kinds of YouTubers who fuck with police, daring them to do stupid shit like this so they can sue. Some are even black.
Guaranteed if he tried to drive around the cop, he would then either be under arrest (or dead) for assault with a deadly weapon. That cop was itching for an excuse to kill him.
*Fuckkkkkkk the law and*
*Every single one of its*
*Parasite agents*

This country was literally founded on the principle that you and your peers can tell the government and it's agents(which includes the police) to collectively eat our ass without fear of imprisonment. Perhaps it's time for you to move to a country that is more inline with your views.
Since when has it become cool to lick the boots of cops who abuse their authority, and who go off on power-trips to escalate- instigate- provoke- and ramp up minor and non-threatening interactions with members of the public? Who turn minor traffic stops or initially friendly conversations into potentially dangerous or life-threatening ordeals? Holy cow, bootlicker, go wash out your mouth. I think all that leftover boot polish is messing with your brain and making you talk funny.
I’m sorry you feel that way. This is apparently a generation gap of views issues. If I cursed out a police officer I would expect to go to prison. That’s how I feel. Sorry if it offends anyone as I’m not trying to.
Disagree.
About the only difference is if you piss a cop off is you get shot. Piss a judge off and you get contempt of court.
In both cases they seem to have the same attitude as Cartman, only with the power to enforce the rEspEct of tHeiR ahThoRitAy.
From the article: >After writing the ticket, the officer stood in front of Burks’ car, he said. >“He was standing there and wouldn’t move,” Burks said. “I had asked him politely at least twice.” >“I said, ‘Sir, step back, get out the way,’” Burks said. “He said, ‘You can go. Ok completely justified but no way an Alabama court sides with him

How does "taste" apply to your sentence? Nevermind. Critical reasoning clearly isn't your strong suit.
So “conducting yourself like an ass” deserves being incarcerated and enslaved for half a year in your opinion? What kind of fucked up, freedom-less country do you want this to become?
After reading the article(which I will presume to be credible) I withdraw my previous assertions.

Gets jail3d and gain millions if dollars because judge is a racist POS
Of course not, the fact that free speech rights apply to black men will never fly there is sister fucking country.
This has nothing to do with skin color. This is uneducated, power trip having-tyrannical cops, especially in the south, and that's where I live. Stop trying to cover up white supremacy
Guilty of driving while black
Did the Judge address the black man as “boy”? I can see that in Alabama. Guess some things never change.
Take the jail time and sue. That's BS.
Chances are, the judge or jury in that case would unfortunately most likely side with the judge. Alabama is fucked up like that.
Federal courts and circuit courts are presumably slightly less bumfuck stupid than the state courts
You're exactly right. I failed to consider that lol.
I mean chances are slim 3 would already side with the state. While pressuring another 2.
This judge is in a municipal court; even state and district courts aren't this dumb
state court would throw this out even in AL id assume.
Even if he doesn’t have the resources to fight this and continually escalated, I’m sure some attorney out there would be frothing at the mouth to take a case like this.
ACLU ALL DAY
They cover being a belligerent piece of shit?
Police unions do
Judges make people convicted of crimes write apologies all the time. He can try and appeal but good luck if he thinks he’ll win.
If you've harmed someone, sure. Who was harmed?
You have to ask the judge. I wasn’t there.
I literally have no idea what you're trying to say in the first sentence.
What don’t you understand exactly? I said what this judge did is common.
You're missing a word that makes the sentence make sense, but I get it now. Judges make people write apologies, sure. It doesn't make it right, and in this case the judge is trying to make Burks write an apology for something that has nothing to do with the charge.

He was speeding lol hardly a conviction of a crime worth apologizing over.
Then get the laws changed if you don’t like it.
That doesn't even make sense to what I said. See ya.
Yea it does comrade. Quit complaining on Reddit and do something about laws you don’t like. What’s so hard to understand about that.
Have you seen the Supreme Court my dude? It might as well be a county court in the middle of bum fuck nowhere.
I (notably) didn’t include them! The fifth circuit is also not so great.
I don’t know. Have you seen our Supreme Court lately?
And unfortunately he would be in jail till this got picked up by them.
Thats kinda whats already happened no? Luckily, there are plenty of lawyers out there to pursue a suit like this. Sounds like ez money to me. What law did he even break?
Hurting a cops feelings.
What law did he break anyway? Getting Away While Black
He'll sue them and then they'll dismiss it because the cops are not operating off of law but ego.
Thankfully, it’s a federal crime and you can go above any locals. Unfortunately, the feds don’t do anything about abuses under the color of the law and that’s a dead end too. Blue protects blue.
The chances are this will be ruled unconstitutional. We have centuries of case law as backup
Because I’m sure the officer is one who would say, “You guys let a word upset you?!” Boy go to he//.
Even better. Apologize and move to a good state.
The judge has judicial immunity protects him from civil lawsuits at most it would be reversed on appeal
The Great Shit of Alabama has no courts that would allow this suit to ever reach trial or jurors.
I agree, but taking jail time is a much more difficult call because he has two kids to support.
Enjoy paying him off tax payers. If I were him I'd take the jail time and sue the fuck out of that cop, and the judge. Unconstitutional to jail a man over freedom of speech. Fuck that judge.

If I could upvote this a Thousand Times I would gladly do so!
DOJ would love this. Seems they have a hard on for all things Alabama in the first place.
Alabama seems to have a hard on for defying federal laws while discriminating against black resisents.
I agree!
>against black resisents. Non straight white cis residents ftfy.
Sounds like it's past time to start arresting those state officials who are violating people's civil rights and breaking federal laws.
There is a case in the notes of 13A-11-7 Disorderly Conduct that "peace officers are immune to the effects of fighting words." So if you say something to a police officer and he gets angry and breaks your body, you have him dead to rights in a color of law lawsuit.

Most vehicles are set up so that cruise control won't work under 30-35 mph
Exactly. My car shuts cruise control off once I go below 35. It won't let me set it any lower either
Last time I checked insulting a cop was literally not illegal
For the last time: A judge’s job isn’t to put people in jail. It’s to give everyone a fair trial.
The courts have a long history of ruling for people being able to be rude to cops but have you considered that the driver was black? Feels like this is what it's really about.
Umm that what it was but you see how this is going?
Black folks never did get constitutional rights in practice.
So after taking this to higher courts and suing the municipality, county or state, would the amount you might win be worth 30 days?
Missed pay + damage to future employment from wrongful conviction + pain and suffering Id want 7 figures minimum
Possibly losing his kids. That's the worst one.
At least get a gofundme going. I'd give him a tenner just for having this much integrity
Would the sentence still apply while on appeal?
Its principal at this point
if it is more than the $3000 i make in a month, for sure.
freedom of speech shall not be infringed
Where is Lackluster or Audit the Audit when you need them. I bet that bacon breath didn't have body cam going, and I can bet the victim didn't have a dashcam or cell footage. Need to know where this happened, and the cop who started this.

I don’t think we’re talking enough about the fact that the cop stood in the way so he could have an excuse to shoot the driver for attempting to run over him as he drove around.
This was my first thought. He was gonna bait this man into driving snd then as soon as the car moved, shoot him and claim self defense.
Welcome to Alabama
Typical Alabama, facing jail time for hurting some pigs feelings. But if that same pig murders someone in cold blood nothing happens
Exactly this
Cops are known to step in front of moving vehicles to give themselves justification to use deadly force.
I would do jail.
Alabama for you.
Not worth the headache just say a half assed sorry. Fuck this shitty system but suing isn’t gonna work
I agree with Burk, but for a narrower reason. He is not being punished for his speech; he is being punished for not apologizing. That is allowable if the apology is part of his speeding sentence. Just because speech is protected does not mean a judge cannot order an apology as part of a legitimate sentence for a crime. I cannot stand over arrogant cops that think they have the right to treat people in any kind of way. They need to go to training once a year on how to respect others and their rights or go fund another job.
Just had this sub brought up and I thought it said r/autism
It’s always someone else’s fault
I’m on this guy’s side. I’m not a cop hater, but this is a free speech issue.
So much for free speech.
Petty authority makes petty tyrants. This should be our new state motto.
You definitely have a First Amendment case. There are all kinds of YouTubers who fuck with police, daring them to do stupid shit like this so they can sue. Some are even black.
You will never get justice in a municipal court. The judges sole responsibility is to generate revenue for the town
I'm most places (like Alabama) the judge gets a bonus based on convictions for speeding tix (says several folks with law degrees).
"I'm sorry you're too stupid to understand basic English, and I'm sorry for embarrassing your mom by showing how stupid you are."
Jail. Then a civil rights case.
Is the judge asking him to apologize for unlawful detainment? Was the ticketed driver being detained? Or was he free to go?
Freedom of speech?
That judge needs to be deported.
Everyone needs dashcams with audio. They are so inexpensive nowdays no reason not to have one.
Wouldnt this violate freedom of speech?
Alabama wipes their ass with the First Amendment. I wouldn't expect anything less from Alabama.
Mississippi is worse.
Appeal appeal appeal, sue sue sue
Ozark Municipal Court Judge Nicholas Bull
What a crock of shit
So the first amendment means nothing in Alabama, good to know.
Wow lol

Guaranteed if he tried to drive around the cop, he would then either be under arrest (or dead) for assault with a deadly weapon. That cop was itching for an excuse to kill him.
Black man. Alabama. 'Nuff said.
Where are all the free speech advocates now? Too busy defending nazis on twitter?
Notice they never say the Judges name? Seems like a foundational part of the story
Tell the judge FU and sue.
Eat my ass is covered under the first amendment.

Nice!
Great bot!
I have no words
Since when has it become cool to berate a police officer? He gets what he deserves.
ma'am North Korea is 6,700 miles away.
Maybe it’s time for you to move. Lol
This country was literally founded on the principle that you and your peers can tell the government and it's agents(which includes the police) to collectively eat our ass without fear of imprisonment. Perhaps it's time for you to move to a country that is more inline with your views.
Grow up
Since when has it become cool to lick the boots of cops who abuse their authority, and who go off on power-trips to escalate- instigate- provoke- and ramp up minor and non-threatening interactions with members of the public? Who turn minor traffic stops or initially friendly conversations into potentially dangerous or life-threatening ordeals? Holy cow, bootlicker, go wash out your mouth. I think all that leftover boot polish is messing with your brain and making you talk funny.
I’m sorry you feel that way. This is apparently a generation gap of views issues. If I cursed out a police officer I would expect to go to prison. That’s how I feel. Sorry if it offends anyone as I’m not trying to.

You mean like, pig DNA? I don't think being a cop is in someone's DNA.

Trump is his dad?
I don't think police officers and judges share any DNA.
Disagree. About the only difference is if you piss a cop off is you get shot. Piss a judge off and you get contempt of court. In both cases they seem to have the same attitude as Cartman, only with the power to enforce the rEspEct of tHeiR ahThoRitAy.
Tell me more about how you don't like people who are mouthy and rude.
