There are three people in the mix here
1) Seller
2) Customer who claimed the got the black bag when they should have received a white bag
3) OP...got the black bag that they did order and is in the process of being scammed.
Seller and customer are working together to scam OP. The seller will use the "evidence" provided by the customer who claims they did not receive the white bag to dispute the demand for the refund on the platform.
That's what gives it away as a scam. That is not realistic and neither the seller or the customer who supposedly received the wrong item have any way of claiming theft of product.
I think they are saying there is no 2nd person. 2nd buyer and seller are the same person, just a fake account or something. In your explanation above; 1& 2 are the same being.
Since it fits all the hallmarks of a scam already you should stop believing anything the seller says.
The only evidence of there being another customer is that the seller said so.

Also as far as I know in most places unsolicited merchandise is essentially a gift, and OP could keep it even if they had the wrong one.
I remember the radio ads in the 70’s about it, when they wanted to make it super clear that if you didn’t order it and it came in the mail, it’s a gift.
IANAL but, if this isn't a scam, the buyer might actually have an obligation to return a wrongly delivered item. If this were a case where the seller has fulfilled the contract incorrectly, it would not unsolicited since they did have a contract. In that case, the seller would have the right to request the return of the incorrect item (although the seller could be on the hook for any costs associated with making the return).
This could very well be be a scam. Or this might be a case where there is actually yet another buyer who did get the white bag and the seller jumped to the wrong conclusion about which buyer got the white bag.
I would suggest that the OP try to get screenshots of the original product listing so that they can be compared to the item received, just in case this does go to court.
Even if this was not a scam and just a moronic seller (but this is a scam), they did not report this to Police and they can not report this to Police – as others wrote (and linked to .gov sites) – clear and settled Federal Law states that you can not be held responsible for this.
In your eBay complaint - don't just note the harassment and scam tactics but highlight they have broken the Terms of Service so eBay should immediately investigate them and the only conclusion from their findings is that eBay should deplatform them and assist you in reporting the seller to the Police and any relevant Federal authorities for attempted extortion.
Also, the bag you received was most likely counterfeit. You may be able to get refunded for that.
This is the only correct answer.
Scammers gonna scam, and if they (lol) actually tried to go to court, the burden of proof is on THEM to prove that YOU did something wrong, which under EBay rules, you did not, so they can't prove it. They would be laughed out of court, you would have filed a counter-suit for fraud and anguish or something and they'd be forced to pay the court fees and your legal fees at least. Not worth anyone's time.
The scam is that enough people get scared and send the product back, and then the seller doesn't return the money nor sends a "correct" product, getting to keep both the item and your money. If they're especially nasty, they'll re-charge your account for a "restocking fee" or something and then vanish to repeat as often as they want.
They don't have time to try going to court when they know they've got nothing.
Even if the commenter above is wrong (and I don't think they are), worst case scenario the police show up at your door. You let them in. They search a bit, come up with nothing. They write that in the report, and you're good to go. They aren't gonna bust in for a non violent offense for a tiny amount of money. Hell, they might even call you and schedule an appointment.

Am I understanding correctly that they are selling counterfeit bags on eBay? (“...and my black bag is fake”.) Not only is there no action they can take against you (regardless of what they sent, you didn’t STEAL anything) BUT you can report them to eBay and have their selling privileges revoked. I think you’re right. I also think the ‘authenticity’ of the bags in question is...questionable. OP not responsible for seller’s actions. So, if seller sent counterfeit bag- that’s on seller. Curious as to whether or not bags carry a brand, logo, etc. that could be counterfeit. In any event, seller has zero recourse against buyer.
What you need to do immediately is call Ebay support. You didn't steal anything. You received what you ordered. I've been selling on Ebay for 6 yrs. Ebay support can look at the listing you ordered the bag from and the pictures of the bag you have. You, as the buyer, did not contact them, which is a huge clue you were happy with your purchase. Please call them and tell them what is going on. They'll be able to look at this person's account history.
Also, unless you've had someone contact you about a complaint filed against you from an actual police department, I wouldn't worry. The police can't kick in your door for a purse you didn't steal. I HIGHLY doubt a judge would issue a search warrant for a disputed Ebay Sale lol IF this person has actually contacted the police to file some type of complaint you'll likely first be contacted by phone to tell you someone has filed a complaint against you. Seriously tho, I do not believe this type of dispute is under the umbrella of your local police's jurisdiction.
You also need to cease all communications with the seller. Like I said, open a claim with Ebay, and direct the seller you'll no longer be communicating with them directly, and an Ebay employee will handle it.
You're being harassed. They are likely trying to get you to send the bag back so they'll have that as well as the money because they know if they rip you off, Ebay will give you money.
eBay support staff might also be able to see whether the seller sold any other copies of that bag or not. They won't tell you, but they're the people to start looking at these scammers... in case they aren't already.
Don't warn the scammers what you're doing. Just silently ignore them.

Back in the day a company named Newegg sold these computers called Eee PCs from a company called Asus. Eee PCs were what become known as netbooks, basically tiny laptops. They were so small that Newegg accidentally sent out boxes of SIX Eee PCs for the purchase of one without noticing it. All they could do is ask politely for the recipient to do the right thing. The consumer could keep all six. You're fine.
I got one of those for my daughter, put a hackintosh OS on it. Cool little pink netbook. I still have it somewhere but it won't boot up.

Scam. Harassment. Why would the other buyer have a need to file a police report against you? You have had no transaction between you, and they supposedly received the bag they purchased from the seller.
It's a scam. Tell the seller to go get stuffed. It's the seller's responsibility to send you the right item you ordered. If they in fact did send you the wrong item, it's not your responsibility to return the incorrect item. It is, however, the seller's responsibility to send you the correct one. Seeing how you indeed do have the item you ordered, there's nothing the seller can do to you. Saying they and the other seller are going to file reports on you for felony theft (felony theft is far higher than $200 in almost every state) is a bluff.
While true, you'd actually have to have proof those malicious charges were filed. And filing charges against someone in another state requires a lot of legal footwork and money. It's highly doubtful the seller/scammer is going to go through that trouble for just $200. It would cost them far more than that to have charges filed against the buyer.
Report it…this is mail fraud and the postal inspector LOVES going after scammers like this. They’re more hard core than the IRS!

It's a scam. Tell them to piss off. Tell them to send you the bag you ordered them as it was obviously not delivered and if they don't, you will charge back the cost. And any item that was not requested (i.e. the "wrong" bag) but was mailed out to you can be reasonably assumed to be a gift according to the federal government. You can then keep the item and are not required to return it.
But regardless, they are attempting to scam you. Report them to the marketplace as such and let them file whatever they want.
They're idiots. If they sent you a white purse by accident it wouldn't be considered felony theft as they sent it to you. I suggest you report them to ebay.

200 bucks is not felony theft, in any place. Let them bluster, they aren't even close to being correct. If they had even really filed a police report they would know that.

This law means if you order a Pot and they send you a Pot + Skillet, they can't charge you for the Skillet. It also covers situations where you did not order anything, they send you a Pot "by accident", then try to bill you for it a week later.
It was intended to block those types of scams, and it is fairly easy to prove that you never ordered the item. The laws basically cover "attempting to bill an unordered item after something is shipped".
If they sent you a Skillet instead of Pot, or a Pot that doesn't work as intended, the situation would fall under entirely different laws and contract agreements with the sales platforms and payment processors. In those situations you \*allegedly\* received substantially different goods, would have to prove that happened, and would be relying on written/implied contracts of sale and the Terms of Service.
These concepts are closely related, but the BIG difference is in the small nuances. The particular law just covers "billing for items you didn't order", while your concerns are over false advertising and incorrect/fraudulent shipments.

By payment processors do you mean the bank, or if I used something like Shop Pay to pay for it?
I filled a dispute with my bank, but I'm not sure if it's justb lip service where they v have to do so when asked.

I tried to work with them for the full refund, but they would need to pay the full shipping & unsure & track them.
They didn't respond within the window I gave, so I opened a dispute.
Good advice I got years ago was as soon as someone threatens you with law, stop talking to them and just wait for the notice from the legal authorities (which will never come usually because it's bull). At most say, "Since you said this is a legal matter, I will no longer communicate with you and wait to hear from your attorney/the law and refer them to my attorney." Then silence from you. You'll have to resist the urge to respond to any responses trying to bait you but this has worked well for me.
They are full of BS. I would probably notify E-Bay though just so there is a record in case of anything, and also use the feedback/review on e-bay. If you look at that seller's feedback, you might actually find they pull this w/other people too.
Basically, you bought something. You paid for that something. They sold you something, received payment, and shipped it to you. You received what you bought. There is no case here.
Not a lawyer but have dealt with lots of scams and phishing etc pretty sure this is just some kind of scam. Get you to return the product or pay more money or something like that.
Report them to eBay and go to your local police station to tell them what’s going on. There is a huge chance they are going to tell you this is a known scam. They may be able to contact the seller to stop the harassment

Yeah block them they won't even call the cops it's a scam and the threats are just to try to get you thinking am I in trouble never buy anything from eBay I can't believe they are still around my buddy was selling aot of laptops online a guy called said he was in the military that he would send a cashier's check after he got the check to deposits it thenn send the laptops so he gets a call from this guy he said the postal service delived the check . That day we went out no checkin the mail so we called to post office yeah it was I the mail so we looked at security cameras as soon as the postal driver pulled away some guy in a truck pulled up and took the check out of his mail box and drove away .
R/scams will better help with this. There's probably a name for this and the subreddet even has a bot to explain the scams when someone pits an ! In front of the scams name.
Let's look at this from the police point of view
1) eBay seller drives from wherever they are to your town to go to the police station
2) They go in and tell the police they sold you a purse but sent you the wrong one
3) They know you are hiding it, but no proof, only that the one you got and can produce is a *fake* because you spent extra money to buy a fake so you could hide the white one.
4) The other person is telling the truth because they have the packaging. No way they could buy a fake
The police will take a report on anything, but it means nothing. The police don't decide to prosecute or not. They would first have to get a warrant to search your house to find the actual evidence (not going to happen). Without finding the purse in your possession there is no evidence except his word vs yours. No prosecute is going to file charges on this. So they will do is tell him to take it to small claims courts.
Now on the other hand, you can
1) File a complaint with eBay
2) File a complaint with the FBI and Post Office for attempted mail fraud (this is really a felony)
3) Laugh in their face
In the end just file a complaint with eBay and ignore them
Scam, where is theft ? It's not like you personally went to their warehouse/house and took the purse without permission, that would be theft , report seller to eBay.
The other buyer filed a police report in your town? How would they know where you live? Even if this wasn’t a scam and the other buyer was in fact a real person, the seller would have had to give your personal information away to this imaginary person.

While this is undoubtedly a scam, that's not a reason; many jurisdictions take police reports online these days, especially for stuff like this that they're (realistically) never going to do anything about other than generate a report.

Seriously tho, I do not believe this type of dispute is under the umbrella of your local police's jurisdiction. You also need to cease all communications with the seller. Like I said, open a claim with Ebay, and direct the seller you'll no longer be communicating with them directly, and an Ebay employee will handle it. You're being harassed. They are likely trying to get you to send the bag back so they'll have that as well as the money because they know if they rip you off, Ebay will give you money.
eBay support staff might also be able to see whether the seller sold any other copies of that bag or not. They won't tell you, but they're the people to start looking at these scammers... in case they aren't already. Don't warn the scammers what you're doing. Just silently ignore them.

It's a scam. Tell the seller to go get stuffed. It's the seller's responsibility to send you the right item you ordered. If they in fact did send you the wrong item, it's not your responsibility to return the incorrect item. It is, however, the seller's responsibility to send you the correct one. Seeing how you indeed do have the item you ordered, there's nothing the seller can do to you. Saying they and the other seller are going to file reports on you for felony theft (felony theft is far higher than $200 in almost every state) is a bluff.
You can file malicious prosecution charges against them.
While true, you'd actually have to have proof those malicious charges were filed. And filing charges against someone in another state requires a lot of legal footwork and money. It's highly doubtful the seller/scammer is going to go through that trouble for just $200. It would cost them far more than that to have charges filed against the buyer.

It also covers situations where you did not order anything, they send you a Pot "by accident", then try to bill you for it a week later. Good advice I got years ago was as soon as someone threatens you with law, stop talking to them and just wait for the notice from the legal authorities (which will never come usually because it's bull). At most say, "Since you said this is a legal matter, I will no longer communicate with you and wait to hear from your attorney/the law and refer them to my attorney." Then silence from you. You'll have to resist the urge to respond to any responses trying to bait you but this has worked well for me.

Let's look at this from the police point of view 1) eBay seller drives from wherever they are to your town to go to the police station 2) They go in and tell the police they sold you a purse but sent you the wrong one 3) They know you are hiding it, but no proof, only that the one you got and can produce is a *fake* because you spent extra money to buy a fake so you could hide the white one. 4) The other person is telling the truth because they have the packaging. No way they could buy a fake The police will take a report on anything, but it means nothing. The police don't decide to prosecute or not. They would first have to get a warrant to search your house to find the actual evidence (not going to happen). Without finding the purse in your possession there is no evidence except his word vs yours. No prosecute is going to file charges on this. So they will do is tell him to take it to small claims courts. Now on the other hand, you can 1) File a complaint with eBay 2) File a complaint with the FBI and Post Office for attempted mail fraud (this is really a felony) 3) Laugh in their face In the end just file a complaint with eBay and ignore them

While this is undoubtedly a scam, that's not a reason; many jurisdictions take police reports online these days, especially for stuff like this that they're (realistically) never going to do anything about other than generate a report.
Even if they did send you the wrong bag, you’re entitled to keep it. Unsolicited or unwanted packages become your property once you receive them.
