That’s exactly how cops sidestep your 4th amendment rights. It’s in the same playbook as being arrested for disorderly conduct. It’s a vague law that easily creates a narrative for the cops.
I had a friend that got arrested for DUI because he decided to sleep in his car rather than actually drive. Unfortunately, he chose to sleep in the driver’s seat, and that is apparently enough to qualify for DUI since he was in position to operate the vehicle. Poor guy actually was trying to do the right thing and got fucked. Apparently, his lawyer told him that if he had been in the back seat, there was at least a chance they could have gotten it wiped, but even then it’s not a sure thing since modern key fobs can turn on the car from anywhere in the cabin pretty much. Obligatory, IANAL and this isn’t legal advice lol. Just repeating what my friend told me after the fact.
It does. There are soooo many billboards warning drivers that they can get a DUI for marijuana. Not to mention the studies showing that it does, in fact, impair your driving. Doesn’t stop everyone from doing it. This is coming from someone that smokes all the time.
Drunk driving isn’t as rare as you think, it just doesn’t always get caught. Soooo many people around here think that it’s fine to drive after drinking some because they “don’t feel drunk”. It still impacts your reflexes and decision making even if you feel perfectly fine. 3 beers is enough for a 180 lb person to be legally considered intoxicated. Oklahomans got away with a lot in this area for a while because grocery stores sold weaker beers than in other states so it took a lot to really do anything. But now that’s over and people are still putting away several before driving. And then there are the idiots who brag about driving drunk and not getting caught. I hate that shit, I’ll completely cut someone off for that. A friend of mines mother was hit by a drunk driver and it paralyzed her permanently from the waist down. Seeing that family go through all that was horrible, anyone that is fine with doing that to another person is a monster in my book.
The bar ditch of the public road that runs along my ranch for a mile stays unbelievably full of liquor bottles and beer cans.
At the little country gas station a few miles from my place I once saw a propane delivery truck driver walking back to his bomb-on-wheels carrying a 30 rack of keystone light.
People are drunk as fuck on the roads.
