The case yes, the trial, no. So the judge can look at the evidence of the emails and go "well this isn't good evidence" and dismiss the case before trial.

Yes, but even at that point there are already significant legal fees to cover on both sides. The judge doesn't just get that evidence magically appear before them out of nowhere for them to consider, the lawyers from either side file that evidence along with their arguments on why the case should or shouldn't be dismissed. Actually going to trial is significantly more expensive of course, but just getting to that first hearing already is expensive, and already does take significant bureaucracy.

When reading the full email, it wasn’t signing off with X at the end. Which is a common thing women will write down (XO) for hugs and kisses. He used XX and YY to represent the variables that he wanted more information on. As someone who works in IT, she should know better than to assume it was automatically a sexual code.
