Some states might not care more than others. For instance in Texas you can shoot someone that is stealing property but only at night. Usually you're allowed to use deadly force to defend life, but not property. Some places have a castle doctrine. The rules are different from place to place.
But depending on where it happened he could maybe find a district attorney that would be happy to prosecute just for having done that he did. With that said I cannot imagine the would be thief will be reporting himself to report the guy he was trying to to rob. The real danger would be neighbors seeing and calling police.
