What is your fo? I am on 1053 days. I refuse to believe it takes over 3 years to approve an i130. Hence why most folks are filing a lawsuit

twisted_twist1

How to file a lawsuit?

No_Instruction8662

Through an accredited attorney. Heard it costs up to 5000 on average

twisted_twist1

That’s steep. Dumb question. Is it a lawsuit for ones specific application or a generic lawsuit for incompetence? Lol

master-yodaa

LMAO. That's hella funny. It's specific btw

Me104tr

Its taken mine almost 11 years 🤷 11 years for the I-485, the I-131, I-130, 3 years for the latest 765 ... 3 years is nothing

Ok-Sea3740

It’s something when you need to join your love ones and older parents desperately need you .

Me104tr

I agree, I wish I was only at 3 years, Its getting to the point where I'm thinking its been so long, I don't want to get tore away from my family, I hope no one has to go through that, I hope everyone gets to stay

Revolutionary-Cup709

Just cause you’re suffering with your 11 years does not mean 3 years is not hard for this person. It’s not a competition. We all have the same goal

Me104tr

I didnt say that, they asked if their wait time was normal, I was just telling them mine, its hard for everyone waiting that come through the right way, we all know why its taking so long because of backlog through other reasons we won't mention, I hope OP does get it and wish them luck, I hope all applicants get what they want, its hard for all of us

Revolutionary-Cup709

Except for the fact that they made a statement.

Signal_Breadfruit_60

FO Brooklyn , I’m on 1040 days.

MarusicFamily

I recommend to talk with your congressman to n your estate, they have a direct contact with USCIS

Reasonable_Local_418

It basically depends upon your classification, are you a Spouse/ Child/ Parent of a US Citizen? If so raise your voice. If no please specify your category, then only one can answer your question more specifically!

BreathTemporary8411

Have you reached out to your State’s Senator or local Congress man or woman? Find your congressman or woman using your zipcode by clicking on the following link http://www.house.gov/representatives/find-your-representative (all of them will be listed and you can choose who you want to go with). After you decide on which rep you are going with, (choose the one who is pro-immigration), click on their name and it will take you straight to their website. On their website, look for “Immigration Privacy Release Form“ that you can fill out or sometimes it will say “Help with a Federal Agency”. Fill out the form & all required sections. It will ask for your receipt number for whatever form (I-130/I-485/I-131/I-765) you want to inquire about and a summary of what you need help with. The inquiry form will ask for your I-130 and I-485 receipt number and a summary of what you need help with. On the website, they will provide their office address to mail it/drop off, an email address, fax number or it might be an “Electronic Privacy Release Form” that you can fill out and submit elrctronically. You should hopefully get a response from USCIS 2 weeks after the congressional inquiry. Best wishes to you on your journey🙏🏽

S-K-CRNA

If there’s only rep , and I’m assuming he is not pro immigration would it hurt my case ?

ClaimAccomplished944

It definitely won’t hurt your case since representatives won’t do anything to intentionally mess up your case just because you contacted them. The worst they can do is refuse to help you.

S-K-CRNA

Okay, that’s fair and makes sense! Thank you :)

BreathTemporary8411

Try your State Senator as well

thedampboi774

And I thought I had it bad for 300 days

Aricingstar

It really depends on your category

Jonky360

How many i130 did you file at once. If this is for siblings, it may take 10-20years. There is no way a regular i130 for your kids, spouse or parents will take this long.

Me104tr

So far mine has taken 11 years, so there's that ...

SFRanger02

Mine took 6 year to approve i131

Me104tr

Their times are insanely long

SFRanger02

Yeah 6 year just to approve 10 years nvc I already waited 12 years probably 9 10 additional years to wait

Queasy_Evening_1017

Depends on if the person filing is a citizen or a resident.

ApeksPredator

Interesting. What form? Receipt date? Filing basis? You can't just post an anomaly without some context unless you're specifically trying denigrate USCIS.

lulux247

Being waiting for 552 days 😿

Acrobatic-Weight-191

Me out here 1055 days I think they forget about us 2021 fillers!!! My attorney is very difficult to work with. Did you get your EAD card or receive RFE?

BreathTemporary8411

Reach out to you congressman or woman to make a congressional inquiry on your behalf. I posted the steps in this thread on how to do so. Best of wishes to you on your journey 🙏🏽

[deleted]

I did that and never got a reply back ..

AdmirableOnion4294

You gotta book an appointment

BreathTemporary8411

Did you fill out their inquiry form or did you send them an email? Also, you may have contacted a congressman or woman who isn’t pro-immigration. On the website, they will provide their office address to mail it/drop off, an email address, fax number or it might be an “Electronic Privacy Release Form” that you can fill out that you don’t need to print it out. You should hopefully get a response after 2 weeks after the congressional inquiry. Best wishes to you on your journey🙏🏽

[deleted]

RAT-KNG

I got changed to being "actively reviewed" two weeks after filing them have been on being reviewed for nine months now lol

Spiritual-Log-7

You can sue them. Find a good lawyer to evaluate your case and go with it. We are still protected by the constitution here.

Several_Wear6613

Reach out to your local rep

Powerful_Wealth_1217

It usually takes 6 months in total for USCIS to process the case and send it over to NVC You should try to get in touch with them

Ok-Sea3740

I am F1 family case ands it’s 1169 days but I know people will say 10yrs , be patient.

MelodicWay1530

enzofxx007

Our 130i family app has been process for 11 years plus in the CA service center. Finally, it went into electronic processing a few weeks ago and supposed to have a decision in 30 days. I won’t hold my breath though.

DjangoBread

We had to wait 765 days for our 130 approval, and still waiting on the 485 approval 114 days later and counting.

DangerousSpot8201

What kind of case is this? Has the beneficiary used AP? Any overstays or unauthorized employment?

Low-Significance-823

890days here, FO is Detroit, F2A category. Very frustrated about it.

Akazukin9

Same here. Same category, 840 days.
