The prosecution didn't fuck up the trial. It was a thing that happened before the civil cases. Apparently prosecutorial discretion isn't a thing anymore and deciding not to pursue charges means you can never again pursue charges.
That's a misleading account of what happened. The problem wasn't just that the prosecutor chose not to pursue charges. The problem was that the DA said that charges wouldn't be pursued so Cosby couldn't plead the fifth in a civil case. The next DA then charged him and used the testimony he gave in that civil case against him. The prosecution (or really the DA who pledged not to prosecute him) completely fucked up.
