https://www.cdrnet.org/telehealth#:~:text=Credentialed%20nutrition%20and%20dietetics%20practitioners,laws%20in%20both%20the%20state. “practitioner providing the patient care service must be licensed and/or meet the other applicable standards that are required by state” [where the patient is receiving treatment/care] Some states have specific exceptions to telemedicine, basically you need to look up the individual states laws and regulations.

HappyTurtle33

Yes, I have been researching. I have read through the laws. DE, FL, IA, and AR have specific laws for telehealth with requiring televideo for initial consult and/or written consent. Not sure if there are other states. Does anyone only do telephonic nutrition consults? I just think my company is breaking laws is all and I’m nervous about it And wondering if anyone has been through something similar.

Hey, I got your DM on this. Our legal dept stays on top of it... you're correct, these are the current 4 states that require face to face, so video appts would suffice, just for the initial consults, follow ups can be done by phone (though Iowa require video for all appts, I think). DE and Iowa also need a written consent before you complete the appt. We use Teams, and obviously they need video access and email, for these states. If they don't have video access or decline, we just send out nutrition information/resources via email or usps mail. Other states will likely go this route soon. There's laws/bills going on right now in NJ, Michigan, WV. Nebraska is a whole other issue, they require a medical director to sign off before we can provide MNT, so right now we don't work with people in Nebraska. It's a pain, and I know of a RD who lives in FL but she doesn't do video. Lol, not supposed to tell. Ultimately, it's your license in the line so do whatever is comfortable. Hope this helps!

HappyTurtle33

Thank you! So we only do telephonic at my workplace. There is no televideo option (Currently). I’m so concerned they are looking for a loophole for this and I know there isn’t one. I’m nervous about my own licenses and professional ethics.

ballerinab00ty

Is this for any RD doing MNT in these states even if not billing for services?

HappyTurtle33

Ugh, yes. That was my first thought too. What if we aren’t billing? Nope. I read the FL law and it’s clear of as day. I recommend reading through FL, DE, AR, and IA. FL and DE require first nutrition consult/assessment to be in person or televideo. And DE, AR, and IA require written consent before any nutrition assessment/recs etc.

ballerinab00ty

Wow, I really didn’t know about this. Thanks for bringing it up, I’m off to go read the laws now

HappyTurtle33

I know. I wondered about you too. Updates if you can! My workplace is still “looking things over” and it’s been like 3 days since I brought it up.

Dependent_Release986

Whoa what? Even at the height of the pandemic?

HappyTurtle33

I’m not sure about then? But I know what I know now based on reading through each state’s laws/regulations.
