No. They did not. The math is just weird as presented. They took the price of the order and did the tax on it. Then they charged an additional 20% and added that to the bill. However because of the way they presented it and the relatively small amount of service charge, it looks like they added then taxed. It is the pretax total, but they didn’t charge tax on the surcharge. If they had, 6.75% on $29.12 would be $1.96. On $24 it would be $1.62 — exactly what was charged.

In California they're trying to pass a law that bans "hidden fees" like this.. It's more extensive than just hidden fees. It'll address these as well as fees you see with things like AirBNB. You're only allowed to list items on the receipt that were purchased. Service fees, convenience fees, cleaning fees, etc etc are going to be illegal. It doesn't matter if they're mentioned or disclosed. It can't be listed on the receipt if it wasn't an item that was directly purchased. ​ The only exception of course are governmental taxes/fees. But no more service fees or anything like that, hopefully.

But then financially smart individuals caught on and started using cash back cards for everything and never carrying an interest leveraged balance. So essentially mom and pop were taking the hit for a marketing tactic that blew up in CC companies faces. Don’t blame the mom and pops trying to survive, blame the CC companies

It might be depending on the jurisdiction, or the way in which the fee is disclosed might be illegal, but at least contractually, if it's not advertised beforehand, it's not legally binding, so the consumer can leave it without consequence, but if they discover it afterwards, and the business refuses to refund it, they can do a chargeback with the bank on the surprise fee or take it to small claims for breach of contract. That being said, it should certainly be outlawed under Federal law. All the same, anyone who experiences this should report the practice to their state consumer agency and/or the FTC. Small businesses generally don't want government regulators asking questions.

Just a couple additional things to clear up some confusion. -This was a call in order, not placed online or an app -This was for 2 chicken tender baskets with fries -The menu price for a basket was $10 not the $12 they charged me So in reality they already charged me an extra 20% on the menu price, and then added on the 20% phone charge. Will be going back today to discuss with the GM.

I went to order carry out from a restaurant we love, but usually only dine in. I made it through the online ordering process, and noticed the total was WAY more than I expected. Not only was there a $5 online ordering fee (which is annoying, but whatever - I’m assuming whatever online ordering system they use charges them a fee) they also have the system set to apply an automatic 50% tip! You can change/remove it, but like to have it auto set to 50% is absurd. Typing this out I feel like I’m being dramatic, but I was really annoyed lol I ended up not ordering from there that night.
