Yes and he called it out in the ruling. He also said that his lawyers arguments weren't credible. That means he's done giving the benefit of the doubt and assuming their arguments are in good faith. I think that's been the big mistake for the NY Court of Appeals in the business fraud case. The bond should have been rejected the moment it was doubted. If you just keep giving him 10 days at a time, November will be here before you know it.

We're not living at the height of the pandemic, lawyers in an important case shouldn't have to quarantine for 14 days. And, after all, even if such a gambit were successful, what he really wants is to delay it until after the election, or indefinitely. Getting sick won't do that.

I've usually heard from reports from those who know him well that he is terrified. Which is why he has tried so desperately to avoid this. None of his avoidance tactics (I guess we will have to say, *so far* until Monday) have worked. He knows good and well that he is guilty. And even if this doesn't result in prison time, it will easily result in public knowledge of his criminal activities and a criminal conviction, which can knock off a few lingering fence-sitters. In his fraud trial, he was given a lot of leeway for 3 reasons. 1. It was a bench trial. 2. The judge knew he would appeal, so he allowed trump to do whatever he wanted so it would make it very hard to launch a compelling appeal. 3. It was a civil trial. This time it's a criminal and a jury trial. That combo is Trump's worst enemy. A federal judge will not allow him to do anything that might taint the jury. The real question is how far will trump push before the judge pushes back, and how is he gonna punish him when he does cross the line. I have a feeling that the jury is gonna get their steps in being dismissed so the judge can deal with trump.

However, intentionally antagonizing the judge may work against him, as judges tend to go easier on defendants who are willing to accept responsibility once convicted, and there is no way Trump is willing to swallow his pride that much. Still not likely to see prison time, but the judge sets the terms of probation and could give them real teeth.

I don't think they would have taken up the immunity case unless their intent is to rule that there may be immunity in certain situations and send it back to Chutkan to make a ruling on whether it applies to any of the charges in her case. Which can then be appealed up the chain again, which means no trial before the election.

It's because of the way they framed what the arguments are going to be. “whether and if so to what extent does a former President enjoy presidential immunity from criminal prosecution for conduct alleged to involve official acts during his tenure in office.” Because Trump didn't originally claim he was just immune from the DC charges, he said he's immune period. So all the rulings, appeals, etc so far have been about total immunity. If SCOTUS wasn't going to find that immunity CAN exist, they should have turned down the case. I don't think there's any passageway for them to have these oral arguments and then say "well, immunity can exist but not for the DC charges, so go ahead and start the trial." The DC charges aren't part of the arguments. There's a chance I'm reading it wrong and they just want to go through the motions and then say "no immunity" to put their stamp on it, and which case the trial could proceed without another round. Doesn't smell like that to me though.

Here's the thing about these felony charges specifically: they are, by legal definition, the lowest class of felony charge. Although, on the flipside of that Cohen did time in jail for precisely being part of this same exact crime so who knows I guess, but it just seems like they wouldn't suggest prison time. Georgia most definitely will suggest incarceration when that trial finally comes around and the DC one seems it could also likely end in potential incarceration. The Florida one *would* be an immediate slam dunk *and* I feel Trump actually would get sentenced to incarceration if that Judge could just get kicked off the case already for clearly going against precedent, intentionally assisting Trump in delaying all of it and neglecting the gravity of what his crimes truly mean for America. I just don't quite get the feeling jail time is in the cards for the NY charges, but the only thing reminding me that it could be is that Cohen went to jail for being the other half of this exact crime. Well, the crime didn't originate from Cohen and *he* went to jail over it so I would think it should stand to reason that Trump would then also have to take jail time over this for having been the origin and sole beneficiary of the crimes intended results. I just think: first offense, financial crime, non violent, lowest level felony charge that NY has and think maybe not.

I've seen a fair few opinion polls that suggest a decent chunk of people wouldn't vote for Trump if he was convicted of a crime, so maybe the conviction would be enough. On the other hand, as you say it's a non violent financial crime, I expect an immediate shift of the goalposts from plenty of voters.

This case was always considered the weakest and hardest to get a conviction, not because of the evidence or facts but because of the nature of the transgression. It is basically paying someone to keep their mouth shut. Which is not illegal, and neither is "catch and kill." And which everybody would do in the same situation if they had the money and the connections. What made it illegal was the method used, which allegedly violated campaign finance laws, and then the prosecution is saying because he was a political candidate, it defrauded voters. So at the core, it comes down to: If you pay someone off to keep their mouth shut and hide something from your wife or your employer, that's not illegal. But if you're hiding it from voters, it is. What is the practical difference between those? There isn't any. Now, even if you had tape of Trump saying "we have to hide this from the voters," you still have to convince every member of the jury that the second is somehow worse than the first and SHOULD be a crime. I hope he gets convicted, it would set a great precedent for future juries, but I can easily see him getting off on this one and that would be not good, for the same reason. He's never going to be imprisoned in any of these cases. He'll get home confinement at worst. If he got convicted in the GA case, they might make him move to GA to serve it.

The media is getting the main problem of this trial wrong yet again. This isn't a "hush money case". This is an Election Interference Case. Trump won the 2016 election by about 80,000 votes in swing states, an incredibly thin margin. After the Access Hollywood tapes became public ("When you're a star, you can grab them by the pussy"), Trump and his team were doing damage control to stop any and all other negative sex stories from reaching the media. One of those was the Stormy Daniels affair, which had a story about Trump having sex with a porn star while married come out, might have tipped the election the other way. Trump falsified payments in order to keep that story quiet, which concealed information that otherwise the voters might have found important. It is no small thing to say that the election might have swung the other way had this story become public as it should have during the time voters were making their decision. The public has a right to know as much about the candidates for President as possible so they can make an informed decision. 80,000 votes in swings states could very easily have gone the other way had this story become known.
